会社がやるべき、７つのパワハラ対策

今回は、どういった行為がパワハラで、会社としてやるべきパワハラ対策についてお伝えします。

6つのパワハラ行為

  1. 上司が部下に対して殴ったり、蹴ったり、嫌いなものを無理やり食べさせる、などの、【身体的な攻撃】
  2. 上司が部下に対して、「半人前のくせに」や「給料泥棒」など人格を否定するような発言をする、【精神的な攻撃】
  3. 仕事のチームから外したり、別室に隔離したり、集団で無視したりする、【人間関係からの切り離し】
  4. 到底できないような納期で多量の仕事を言いつけるや、バスの運転手さんが会社の草刈りを一日中など、肉体的苦痛を伴く環境下で勤務に関係のない作業を命ずるなどの、【過大な要求】
  5. 部下を退職させるために、仕事をそもそも命じないや誰にでもできるような仕事しか与えないなどの、【過小な要求】
  6. 労働者を職場外でも継続的に監視したり、私物の写真撮影をしたりし、本人の了解を得ずに他の労働者に暴露するなどの、【個の侵害】

注意したいのは、この６つだけが職場のパワハラというわけではなく、この行為以外にも、誰にも気づかれないように行っている陰湿ないじめや、嫌がらせなどのハラスメントもあるということです。

周囲は気づかないようなことでも、本人がハラスメントの被害を受けていることもありますので、被害者の話を注意深く聞く必要があります。

裁判例から見るパワハラ

また最近は、パワハラの被害を受けた方が、裁判で訴えることも多くあります。判決をみると、行為者本人だけでなく、会社側も安全配慮義務違反など連帯責任で、損害賠償の支払いを命じられるケースが多くあります。

ですので、会社として、パワハラが起こらないような予防と、パワハラが起こった時の対応をきちんと、とれるような体制づくりを行っていく必要があります。

社内体制を整えておくことで、会社からパワハラをなくし、従業員が元気に生き生きと働ける職場を作ります。

パワハラ対策の取り組みの進め方

  1. 経営者からのメッセージ：組織のトップが、これから会社のパワハラをなくしていく！という強いメッセージを、従業員へ伝えます。
  2. ルールを決める：行為者への対処方針・対処内容を就業規則へ規定し、従業員へ伝えます。
  3. 相談窓口の設置：相談窓口を、社内・社外に設置し、外部専門家と連携する
  4. 実態を把握する：従業員アンケートを実施する
  5. 教育する：ハラスメント研修の実施
  6. 再発防止のための取り組み：事実関係の迅速・正確な確認、被害者に対する配慮、行為者に対する対応、再発防止に向けた対応
  7. 周知する：組織の取り組みについて、周知・啓蒙活動を行うなどになります。

まとめ

ハラスメントに関する取り組みを継続的に行うことで、自分自身がパワハラをしないように注意したり、誰かがパワハラを受けていたら、注意したり、相談できるようになったり、少しずつ職場の働きやすい職場になっていきます。

いじめやパワハラを受けたがために、離職してしまったり、精神的な病気になったりする人を一人でも少なくして、みんなが元気にいきいきと働いたり、生活していけるような社会になっていってほしいです。
